Guide To Renting and Leasing Properties In Dubai


The 5 rules you must follow if you are planning renting an apartment in Dubai — either before you rent, whilst renting, or when (uh oh!) you’re evicted or just looking to move. Follow these simple rules for a trouble-free renting experience in the city.

Rule #1: Work only with RERA-registered brokers.
If your broker does not have a Broker ID card, work with someone else. Period.
This is as plain, simple and straightforward as it ca get. Going through a non-registered broker is just asking for trouble.

Rule #2: Register your contract with Ejari to make it legal.
Go to any typing center with your documents and register your contract with Ejari by paying AED 195 fee. Deposits, such as security deposits or others, should also be stated in your Ejari. Ensure that you get a receipt for the deposit and retain this along with proof of ownership of the property and a copy of the landlord’s passport.

Rule #3: Your landlord cannot raise your rent on a whim according to Decree No (43) of 2013.
If he/she does so, you can file a case with the Rent Committee based on Decree No (26) of 2013.

Rule #4: Increase in rent must follow the Rent Index set by RERA.
If your rent is up to 10% less than the average rental value of similar units, your landlord cannot increase your rent. If your rent is 11-20% less than the average rent of similar properties in the area, the landlord is legally entitled to a rent increase by 5%.Your landlord can hike your rent by 10% if your current rate is 20-30% lower than the going value. A 15% increase can be made if your rent falls short by 30-40% of the average rent. Your rent can be increased by 20% if your rent is more than 40% less than the average rental value of similar.units.

Rule #5: Use the rental calculator to know how much your landlord can legally raise the rent.

Federal Law No. 8 of 1984, as amended by Federal Law No. 13 of 1988 – the Commercial Companies Law – and its bylaws govern the operations of foreign business. In broad terms the provisions of these regulations are as follows: The Federal Law stipulates a total local equity of not less than 51% in any commercial company and defines seven categories of business organization which can be established in the UAE.
It sets out the requirements in terms of shareholders, directors, minimum capital levels and incorporation procedures. It further lays down provisions governing conversion, merger and dissolution of companies

Setting up a free zone Establishment
A Free Zone Establishment – or FZE – is an establishment formed and registered within the Free Zones and regulated solely by the Free Zone authorities. Such establishments must have a capital of at least Dh.1 million and liability will be limited to the amount of paid-up capital. A FZE need only have a single shareholder and is an independent legal entity. Any company, organization or individual wishing to form a Free Zone Establishment must submit a completed application to the Free Zone authorities.
A decision on whether permission has been granted will be given within 30 days of receipt of the application and any other information and documentation required. If permission is granted, the authorities will record all relevant details in the FZE Register and issue a Certificate of Formation. This will specify the date of registration after which the FZE will be free to conduct any such business as is permitted in its license.

We’ve all been through that sinking feeling when the house rent is due. Like any other city in the world, Dubai too has it fair share of areas which offer high rent apartments as well those which are on the other end of the scale.  Jumeirah Beach Residence (JBR) is one of the most popular localities in Dubai and living there comes at an expense, from  DHS 95,000 to DHS 116,000. Once your landlord accepts your offer, next you need to provide the following documents to create a legal contract.

1. Residency Visa
2. A Copy of your passport
3. Emirates ID
4. 5% Deposit cheque of the rental Value (if unfurnished)
5. 10% Deposit cheque of the rental Value (if furnished)
6. 5% agency fee of the rental value, for example, assume you have rented an unfurnished property in Dubai that costs you 130,000 AED per annum, then you need to pay 6,500 AED to the agent and 6,500 AED as a deposit.

After all this has been shared with the agent, then your tenancy contract will be drafted and sent over to you for final approval.

Signing the rental house contract
Once you and the owner of the house (landlord) sign the tenancy contract, next you will need to register your lease with the Ejari and also connect with your Dubai electricity and water authority ( DEWA)
Remember, DEWA deposit will vary according to the type of house you have chosen. For example if you are renting a house in Dubai, then the deposit will be 4,000 AED and an admin fee of 130 AED.

On the other hand, if you are renting a apartment, then the deposit fee will be 2,000 AED but the admin fee would remain the same. The fee for Ejari is 215 AED.
